No one shall construct any structure for private or public purpose on Government, public or community land. But in the case of government or public land, any structure can be made by the concerned community for the purposes deemed appropriate by the Nepal government and in the case of community land for public purposes.
(2) Contrary to sub-section (1), if anyone starts to construct any structure on government, public or community land, the relevant Chief District Officer or local level shall stop such work immediately.
(3) If anyone has constructed any structure on government, public or community land contrary to sub-section (1), the concerned Chief District Officer shall give fifteen days to the principal person who constructed the structure to demolish such structure.
(4) Within the period given under sub-section (3), the main person who builds such a structure shall demolish the structure at his own expense.
(5) If the main person who built such a structure does not demolish the structure within the period given under sub-section (3), the concerned chief district officer shall demolish such structure himself.
(6) In accordance with sub-section (5), the Chief District Officer may charge the expenses incurred in demolishing a structure from the main person who constructed the structure and fine him up to twenty five thousand rupees for constructing such a structure.
(7) According to sub-section (2), if the local level requests any assistance in preventing the construction of any structure or demolishing the existing structure, it shall be the duty of the concerned police office to provide necessary assistance.
